The Plans behind the Plan

The Council of Ministers commissioned consultant Sir John Elvidge to report on creating the Isle of Man Government as a Single Legal Entity. It will be come before *November Tynwald for endorsement.

On the face of it the proposal seems sensible, but digging deeper some commentators see unintended consequences, believing it to fundamentally alter the relationship that the IOM citizen has with the State.

Civil rights campaigner Tristram Llewellyn Jones is one such person. He gave a presentation to an open meeting of the Liberal Vannin Party 12.11.12. and we publish the main points of his talk here.

*  "That Tynwald endorses the report into Government as a Single Legal Entity by Sir John Elvidge and requests the Council of Ministers to report to Tynwald, by no later than June 2015, with recommendations on the means of implementing the proposals contained in the report."

Yes, it's that time of year again!

We'd like to thank all members for their invaluable support last year (and all those that kindly donated towards the expense of our public meetings). Your support has enabled us to put on many PAG events on a very wide spectrum of issues. All events were well attended, often with many politicians and civil servants in the audience.  We hope you have enjoyed the meetings and are pleased at the way PAG has matured into a respected community voice.

Criminal Justice (Miscellaneous Provisions) Bill 2009

The Home Affairs Department received 81 responses to their consultation on the Criminal Justice (Miscellaneous Provisions) Bill 2009.

A few provisions have been removed but the vast majority of the draft Bill (which contains 78 Clauses) is unchanged. Significantly - in over 30 cases - the Home Affairs Department is seeking 'by Order' to self-amend the legislation.

This gives them wide powers to create new offences as and when they please without parliamentary scrutiny. Given that the Isle of Man Constabulary has a presence in that Department there is concern that should the Bill become law,  the Police will have an undue influence in the direct formation of this self-amending legislation. Thus the protection afforded the citizen by the separation of powers between the legislative and executive branches of government is breached.
